There is an element in the RLC protocol called "maxRetxThreshold" which when exceeded causes a radio link failure

Yes, But this variable will be incremented when RLC does re transmission,  But weather to re-transmit or not RLC requires status PDU. If the status PDU itself didn't receive then what basis it retransmit and when it does retransmit.
In that case it will depend on t-StatusProhibit timer value.

During re-establishment/HO transmitter RLC (NR) will give the information about last succesfull sent SN to PDCP . But in LTE - NR case how does LTE PDCP understands RLC NR status. Do we need to modify the LTE PDCP functionality to interoperable with NR?
