How does an eNodeB recognize, it has to send rrc connection reject message with "Delay Tolerant access" to an UE ?

When an UE sends RRC Connection Request message with establishment cause " delayTolerantAccess-v1020", eNodeB may send RRC Connection Reject message with "RRCConnectionReject-v1020-IEs" IE to UE. It is an extended wait time whose value ranges from 1 to 1800 seconds.

Usually it happens when MME loaded and it has informed to eNodeB not to accept rrc connection request with establishment cause "delayTolerantAccess-v1020" .

Why HARQ ACK delay is 3ms? As such i saw , as soon as MAC receives Tb it sends ACK in next SF but UE takes 3ms to receive the ACK why is this delay?
